Is Marijuana Legal in Dallas, Texas?

Marijuana for adult use remains illegal in Texas. Possession of two ounces or less is considered a misdemeanor and can land you in jail for 180 days to a year with a fine of $2,000 to $4,000.

Dallas has a “cite and release” policy in place. People caught possessing four ounces or less of marijuana are no longer arrested and will be released with a citation.

Medical cannabis products, on the other hand, are legal, but only if they contain no more than 0.5% THC. These products are also only available to patients with qualifying medical conditions such as seizure disorders, intractable epilepsy, autism, terminal cancer, amyotrophic lateral sclerosis, multiple sclerosis, and incurable neurodegenerative diseases, among others.

To qualify for the medical marijuana program, you have to be a resident of Texas and must be diagnosed by a registered physician with one of the state’s qualifying medical conditions. The physician will then enter your prescription into the state’s Compassionate Use Registry of Texas system, and you can have your prescription filled in any of the state’s licensed dispensaries.

There are no age restrictions to get into the state’s program, but patients under the age of 18 require a legal guardian.

Of note, State Representative Jessica Gonzales, in March 2021, filed House Bill 3248. If this passes, it would give counties as well as municipalities the option to legalize marijuana for adult use either by ordinance or order.

Is Delta 8 THC Legal in Dallas, Texas?

Delta 8 THC is a type of psychoactive cannabinoid. Its potency is weaker than delta 9 THC — which is the primary form of THC found in marijuana products.

It’s naturally found in both hemp and marijuana since delta 8 THC comes from the degradation of THC.

Through special techniques, CBD can also be converted into delta 8 THC — which brings this cannabinoid into a bit of a grey area.
